Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TopoQuizz mobile application (the "App") operated by SHEMED YISRAEL SOFTWARE CREATION LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Who We Are

TopoQuizz is a mobile learning application for Spanish-speaking medical students, covering topics such as anatomy, pharmacology, and related subjects. It is operated by SHEMED YISRAEL SOFTWARE CREATION LLC. Contact: administracion@shemayisraelsrl.com

2. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you may not use the App.

3. Account Registration

To access certain features, you must create an account. You may register directly or use a third-party login provider such as Google or Facebook. You agree to:

• Provide accurate and complete information during registration
• Keep your credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to other users or to our systems.

4. Use of the App

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the App or its infrastructure
• Reverse engineer, decompile, or disassemble the App
• Use the App to transmit harmful, offensive, or misleading content
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the integrity or performance of the App
• Scrape, harvest, or extract data from the App without our written permission

5. Third-Party Login (Facebook, Google)

The App supports login via Facebook and Google. When you use these providers, you authorize us to access certain profile information (such as your name and email address) as permitted by your settings on those platforms. Your use of these services is also governed by Facebook's and Google's own terms of service and privacy policies.

We do not receive your password for these third-party accounts. We only receive the information you authorize during the login flow.

6. Intellectual Property

All content within the App — including quiz questions, text, graphics, logos, animations, and software — is owned by or licensed to SHEMED YISRAEL SOFTWARE CREATION LLC and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any content in the App without our prior written consent.

7. Educational Disclaimer

The content provided in TopoQuizz is intended solely for educational and study purposes. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical decisions. We make no warranties regarding the accuracy, completeness, or timeliness of the educational content provided.

8. Advertising

The App may display advertisements served by us or by third-party advertising partners. By using the App, you consent to the display of such advertisements. We are not responsible for the content of third-party advertisements or the products and services they promote.

9. In-App Purchases and Subscriptions

Certain features of the App may be available through paid subscriptions or in-app purchases processed via the Apple App Store or Google Play Store. All purchases are subject to the applicable store's terms and refund policies. We do not process payments directly.

10. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by applicable law, SHEMED YISRAEL SOFTWARE CREATION LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the App, even if advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or USD $10, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless SHEMED YISRAEL SOFTWARE CREATION LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App or your violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

You may stop using the App at any time. Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination will remain in effect.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Broward County, Florida.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the App after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
